Terms of service

1) Eligibility & accounts

You must be at least 18 (or the age of majority in your state). You’re responsible for your account and all activity under it. By providing contact details you consent to receive transactional messages; you can opt out of marketing at any time.

2) Product info, fitment & use

  • Verify year/make/model/engine/trim/VIN and read product notes before ordering. We can help with fitment, but final selection is your responsibility unless we confirm fitment in writing for your VIN.

  • Installation: Use qualified installers and follow torque specs and safety procedures. You assume all risks from installation and use.

  • Emissions/competition: Certain products are for off-road/competition use only and may not be legal on pollution-controlled vehicles or public roads (e.g., CARB states). You are responsible for compliance with all laws, including Prop 65 where applicable.

  • We aim for accuracy, but errors/omissions/price or availability changes may occur. We may correct or cancel orders with incorrect information.

3) Orders, payment & fraud screening

Placing an order is an offer to buy. We may accept or reject any order (e.g., suspected fraud or unavailable items). You authorize us and our processors to charge your payment method for the order total (items, taxes, shipping, approved adjustments).

4) Shipping, risk of loss & delivery issues

  • Orders may ship from multiple warehouses or manufacturers (dropship). Posted ETAs are estimates.

  • Risk of loss transfers at carrier pickup unless the shipment is insured/signature-required.

  • If tracking shows delivered but you can’t find the package, contact the carrier and us within 7 days so we can help start a trace/claim.

5) Backorders, substitutions & cancellations

If an item is backordered, we’ll email options to wait, approve a comparable substitution, or cancel for a refund. Custom or special-order items may be non-cancelable once placed with the manufacturer.

6) Returns & refunds (summary—see policy)

Most new/unused items in original packaging may be returned within 30 days with an RMA; manufacturer restocking fees may apply. Installed/used/electrical/custom/clearance items are typically non-returnable. Refunds go to the original payment method after inspection. Shipping costs are non-refundable except for our error.

7) Warranties & disclaimers

  • Manufacturer warranties (if any) apply; we assist with claims as required. MYR provides no separate warranty beyond the manufacturer’s.

  • AS-IS: To the fullest extent permitted by law, the Site and products are provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement.

  • LIMITATION OF LIABILITY: MYR is not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits). Our total liability for any claim will not exceed the amount you paid for the order at issue.

8) User content & reviews

If you submit reviews/photos/videos, you grant MYR a non-exclusive, worldwide, royalty-free license to use and display that content for marketing and support. You represent you own the content and it doesn’t infringe others’ rights.

9) Intellectual property

All Site content, logos, images, and text are owned by MYR or our licensors and protected by IP laws. You may not copy, resell, or exploit the Site or its content except as allowed by these Terms.

10) Prohibited uses

Don’t (a) use the Site for illegal purposes, (b) bypass security or abuse the checkout, (c) scrape or harvest data without permission, (d) interfere with the Site’s operation, or (e) misrepresent affiliation with MYR.

11) Third-party links & vendors

The Site may link to third-party sites and use third-party fulfillment. We are not responsible for third-party content, policies, or actions.

12) Dispute resolution (choose one and delete the other)

Option A — Arbitration: Any dispute will be resolved by binding individual arbitration administered by the AAA Consumer Rules. Seat: Florida. Governing law: Florida. No class actions. You may opt out within 30 days of your first purchase by emailing mattmullen@machyetiracing.com with subject “Opt Out of Arbitration.” Either party may bring a qualifying claim in small-claims court.

Option B — Courts: The parties agree to the exclusive jurisdiction and venue of the state courts in Highlands County, Florida or the U.S. District Court for the Middle District of Florida. Florida law governs, without regard to conflict-of-law principles.

13) Changes

We may update products, pricing, and these Terms at any time. Changes apply prospectively; the Effective date shows the latest version. Continued use means you accept the updated Terms.

14) Force majeure

We aren’t liable for delays/failures due to events beyond our reasonable control (e.g., supplier shortages, carrier delays, labor disputes, natural disasters).
